Terms and conditions
1. Price Information The prices shown are only applicable to purchases made via the Cherish website. Prices in our shops may be higher or lower than shown. Special Offers and promotions advertised in the press or other media may be excluded unless specifically advertised as available online. All prices are correct at time of display online and include V.A.T. where appropriate. We regret we are not able to offer VAT exclusive pricing for deliveries to the Channel Islands. In the unlikely event of an administrative error resulting in an incorrect price being displayed, we reserve the right to correct the price. In these circumstances, you will not be bound to continue with your purchase, and will be asked to email us to confirm that you wish to proceed.
2. Ordering Goods Our online store can accept orders originating from and for delivery to UK and BFPO addresses. To order goods from our online store simply click the "add to basket" button on the product information page. If a product is not available to buy online the "add to basket" button will not appear and will be replaced with "continue shopping". After making your selections use the "continue to checkout" link. You will be able to review and amend your order before proceeding through the checkout pages. We will ask for details of your billing address - this MUST be the address at which your Credit/Debit card is registered - and email/phone contact details so we can contact you if we need to discuss your order. You will be given the opportunity to select a different delivery address later in the checkout process. Finally we will ask for details of the Credit/Debit card you wish to use to make your payment. Clicking "order now" will generate and transmit your order and display a page confirming the details of your order for your records. If you need to amend your order after it has been generated, please contact us either by email or telephone (01202 396660, Mon-Sat 9am-5.30pm). Cherish will confirm receipt of your order by sending an email to you using the address you supplied when registering with our website, however this will not bring into existence a legally binding agreement between us. All orders placed with Cherish are subject to stock availability and to the validation checks described in section 4 below. Also please refer to section 1 above regarding incorrect prices. No contract will exist between you and Cherish for the sale of products by us to you until your credit/debit card has been charged. This will be deemed to be our acceptance of your order and to have been effectively communicated to you. Please note that the only language in which the contract can be concluded is English. 3. Payment We accept payment by most major credit or debit cards and paypal. Payment will be debited to your account before the despatch of your purchase. Barclays Ltd processes all credit and debit card purchases made by our customers for a fee. Customers are not charged for this service. 4. Validation Checks All credit and charge card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to us, we will not be liable for any delay or non-delivery.
We may need to contact you by letter, telephone or email to verify details before we are able to dispatch your order or we may be unable to accept your order. 5. Liability The majority of card issuers cover all the charges that may result from unauthorised use of your credit card or debit cards, but some may limit your liability to £50. If you believe your credit or debit card has been subject to unauthorised use you should contact your card issuer without delay. 6. Delivery of Goods We can deliver to addresses within the United Kingdom although for deliveries to non-mainland UK addresses and certain remote locations e.g. Scottish Isles, Isle of Man, Isle of Wight, Northern Ireland, Scottish Highlands, Channel Islands there may be an additional delivery charge and slightly longer delivery lead time. This charge will be shown clearly during the checkout process.
Goods can be delivered either to your home address, to an alternative address or to your work.
Your order will be delivered either by Royal Mail, Royal Mail Recorded Delivery or by Courier. A signature is required for all Royal Mail Recorded Delivery and Courier deliveries.
Please note that we are unable to insure glass or ceramic/pottery items unless the courier service offer that option and it can be charged at cost to the customer. We pack them with as much due care and attention as possible without having to add a supplementary charge to the customer.
6a. Delivery Charges If a product is available to purchase online, post and packaging is charged in addition to the prices shown.
We make every effort to keep our delivery charges as low as possible. The delivery charge depends on the size of the product ordered. You only pay one delivery charge irrespective of the number of products ordered. If you order 2 or more products that fall into different categories, the higher charge will apply:
Product Type Goods small enough to be sent by Royal Mail will be charged up to a maximum of £9.99 When you add products to your shopping cart the appropriate charge will be added automatically. All delivery charges will be shown clearly throughout the checkout process.
6b. Delivery Times Delivery times are calculated in working days - i.e. Monday to Friday inclusive (working days do not include weekends or National Bank Holidays). In case of Bank Holidays please allow an extra 2 working days.
From the receipt of your order we will endeavour to deliver your chosen items to you within 7 working days providing the goods are in stock, unless a longer delivery time is shown on the product information page.
Deliveries to non-Mainland or remote locations may take longer.
Risk in the goods will pass to you on delivery.
Goods delivered by courier should arrive between 9am and 5pm, Monday to Friday. All deliveries must be signed for. If you are out when the courier arrives the Courier will leave a card with the contact number for you to call to arrange a suitable time for redelivery or for you to collect the goods from the local depot.
IMPORTANT We do everything we can to meet the delivery time specified in this section, however occasionally delivery times may be affected by factors beyond our control and cannot be guaranteed. We will inform you if we become aware of an unexpected delay.
7. Restrictions on Ordering and Delivery We can only accept orders from holders of credit or debit cards registered at UK addresses. We can deliver to most addresses in the U.K. For postage charges Worldwide, please contact us via phone or email before ordering. Deliveries to British Forces Posted Overseas are restricted by both size and weight. Please contact us by email at cherishgifts@fastmail.co.uk if you require further details. 8. 9. Unwanted Goods If you decide that you do not want any item which we have delivered then, provided that it is returned to us in its original and unused condition (including in its original packaging), along with the wrapping and delivery note (as proof of purchase) within 28 days of delivery, we will exchange it or offer a refund. Methods of return are as follows:
i. By Post. You are advised to obtain a certificate of posting (available from all Post Offices at no charge) when returning items by post.
ii. To our Shop. Simply return the item to our Shop for a replacement or refund.
iii. Collection by Cherish. Where there is no fault found with the goods we do not refund delivery charges and may charge for collecting the goods if they are not taken into a our shop. This guarantee is in addition to and does not affect your statutory rights. If you post the item to us, or we collect it, we will endeavour to send you a replacement or refund your payment, within 14 days
10. Faulty Goods If you purchase a product from us which is found to be faulty we will supply a replacement product, arrange for a repair or give you a refund of the purchase price. Simply return it to us by one of the above methods:

Please note that all refunds will be subject to a £2.50 fee to cover time and costs of the credit card company. No charge will be made if payment is refunded via paypal.
